Photo Usage & Copyright Policy

1. Copyright Ownership

Unless otherwise agreed in writing, photographs created by AJP PIXELS are protected by applicable copyright law and remain the property of the photographer or applicable copyright owner.

Purchasing photography services or receiving digital photographs does not automatically transfer copyright ownership to the client.

AJP PIXELS generally retains the copyright in photographs unless a separate written copyright transfer or assignment agreement has been completed.

2. Client Personal Use

Unless otherwise stated in the client's written agreement, AJP PIXELS grants the client a personal, non-exclusive license to use delivered photographs for personal purposes.

Personal use may include:

• Printing photographs for personal use
• Sharing photographs with family and friends
• Posting photographs on personal social media accounts
• Displaying photographs in the client's home
• Creating personal photo albums

3. Social Media Sharing

Clients are welcome to share photographs delivered by AJP PIXELS on personal social media accounts, provided that the photographs are not used for commercial purposes.

When practical, clients are encouraged to credit AJP PIXELS when sharing photographs online.

Clients should not remove copyright information or intentionally misrepresent AJP PIXELS as another photographer or creator.

4. Commercial Use

Commercial use of photographs may require additional written permission or a separate commercial license.

Commercial use may include:

• Business advertising
• Corporate marketing
• Paid advertisements
• Product marketing
• Publication in commercial materials
• Resale of photographs
• Use by another business or organization

Clients should contact AJP PIXELS before using photographs for commercial purposes.

5. Resale and Redistribution

Clients may not sell, license, redistribute, or otherwise commercially transfer AJP PIXELS photographs to another person or organization without written permission.

This includes uploading photographs to stock photography websites or other services where the photographs may be licensed or sold to third parties.

6. Editing and Alteration

Clients may make reasonable personal-use adjustments to photographs for social media or personal printing.

Clients should not significantly alter, manipulate, misrepresent, or modify photographs in a manner that falsely represents the work of AJP PIXELS.

Commercial modifications or derivative uses may require written permission.

7. AJP PIXELS Portfolio and Promotional Use

AJP PIXELS may request permission to use photographs created during a client's session or event for portfolio, website, advertising, social media, marketing, promotional, or educational purposes.

Client permission for promotional use should be provided through a separate written photo release or applicable provision in the photography agreement.

AJP PIXELS does not assume that booking photography services automatically provides unrestricted permission to use identifiable client photographs for promotional purposes.

8. Photographs of Children

Photography services may involve photographing children during family events, graduations, weddings, church events, community events, and other occasions.

Where photographs of children are intended to be used by AJP PIXELS for promotional or public-facing purposes, appropriate client authorization or photo-release procedures should be completed.

9. Copyright Notices

Clients should not intentionally remove copyright notices, watermarks, metadata, or other identifying information from photographs when doing so would violate the terms of their agreement or applicable law.

10. Unedited and Original Files

Unless specifically included in the client's package or agreed to in writing, AJP PIXELS does not provide unedited RAW files, working files, or original editing files.

AJP PIXELS determines which final photographs are selected and delivered as part of the agreed photography services.

11. Copyright Transfer

Copyright ownership will not be transferred to a client unless AJP PIXELS and the client enter into a separate written copyright transfer or assignment agreement.

Any copyright transfer should clearly identify the photographs covered by the transfer and the rights being transferred.

12. Third-Party Use

Clients are responsible for ensuring that third parties who receive photographs from them comply with the applicable usage restrictions.

Providing a photograph to another person does not automatically grant that person commercial or unrestricted rights to use the photograph.

13. Copyright Protection

AJP PIXELS reserves the right to take appropriate action when photographs are used without authorization or outside the rights granted to a client.

Clients who believe their rights have been affected or who have questions about permitted use should contact AJP PIXELS before using or distributing photographs in question.

14. Relationship to the Booking Agreement

This Photo Usage & Copyright Policy is intended to be used together with the AJP PIXELS Photography Booking Agreement.

If a signed agreement contains specific copyright or usage terms that differ from this general policy, the terms of the signed agreement will govern to the extent permitted by applicable law.
